End User License Agreement

License Grant

You are granted a non-exclusive, non-transferable, limited license to use GenderAPI for internal business purposes. All rights not expressly granted remain with the Publisher.

Usage Restrictions

• You may not reverse engineer, decompile, or disassemble any part of the service.
• You may not use the service for any unlawful purpose.
• Resale, sublicensing, or offering the service to third parties without written permission is prohibited.

Data Privacy

Successful GenderAPI query inputs are processed to provide the requested result and are not stored. Email query inputs are never stored. Only non-email queries for which no gender result can be found may be retained for the limited purpose of improving GenderAPI. Query inputs are not disclosed to third parties.

Excel and CSV uploads may be retained for up to five days and are then deleted. Customers may delete an uploaded file immediately after exporting their results. Google Sheets data is processed in real time and is not stored or logged. File contents and Google Sheets input or output data are not disclosed to third parties.

Separate account, payment, support, security and consent-based analytics information may be processed by service providers acting on the Publisher’s behalf where necessary for the relevant function. Customer is responsible for having an appropriate legal basis and obtaining any consent required for the data it submits. For more information, see our Privacy Policy and GDPR Privacy Information.

Service and Support

The Publisher may provide support at its discretion. No guaranteed uptime or service level is implied unless otherwise stated.

Confidentiality

Any confidential information exchanged between the parties will be protected and not disclosed to third parties without consent, except as required by law.

Limitation of Liability

Publisher’s total liability under this Agreement is limited to the amount you paid for the service in the 12 months preceding the incident. Publisher is not liable for indirect or consequential damages.

Termination

Either party may terminate this Agreement with written notice. Upon termination, your license to use the service ends immediately.

Governing Law and Jurisdiction

This Agreement and any dispute arising out of or relating to it or the licensed service shall be governed by the laws of the State of New York, United States, and applicable United States federal law, without regard to conflict-of-law principles.

Subject to any mandatory consumer-protection rights that apply in your place of residence, the state and federal courts located in New York County, New York shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts. Mandatory Microsoft Marketplace terms continue to apply where they cannot be varied by this Agreement.
