End User License Agreement

License grant

Customer को GenderAPI अपने internal business purposes के लिए इस्तेमाल करने का non-exclusive, non-transferable और limited license दिया जाता है। स्पष्ट रूप से grant न किए गए सभी rights Publisher के पास रहते हैं।

इस्तेमाल की पाबंदियाँ

• Service के किसी हिस्से को reverse engineer, decompile या disassemble नहीं किया जा सकता।
• Service का इस्तेमाल किसी unlawful purpose के लिए नहीं किया जा सकता।
• Written permission के बिना resale, sublicensing या Service को third parties को उपलब्ध कराना prohibited है।

Data privacy

सफल GenderAPI query inputs requested result देने के लिए process होते हैं और store नहीं किए जाते। Email query inputs कभी store नहीं किए जाते। केवल ऐसी non-email query जिसका gender result नहीं मिलता, GenderAPI सुधारने के सीमित उद्देश्य से retain की जा सकती है। Query inputs third parties को disclose नहीं किए जाते।

Excel और CSV uploads अधिकतम पाँच दिन रखे जा सकते हैं और फिर delete होते हैं। Customer results export करने के बाद uploaded file तुरंत delete कर सकता है। Google Sheets data real time में process होता है और store या log नहीं किया जाता। File contents तथा Google Sheets input/output data third parties को disclose नहीं होते।

अलग account, payment, support, security और consent-based analytics information, संबंधित function के लिए आवश्यक होने पर Publisher की ओर से service providers process कर सकते हैं। Submitted data के लिए उचित legal basis और आवश्यक consent प्राप्त करना Customer की जिम्मेदारी है। अधिक जानकारी Privacy Policy और GDPR Privacy Information में है।

Service और support

Publisher अपने discretion पर support दे सकता है। अलग से स्पष्ट न किए जाने तक कोई guaranteed uptime या service level implied नहीं है।

Confidentiality

Parties के बीच exchange हुई confidential information को सुरक्षित रखा जाएगा और consent के बिना third parties को disclose नहीं किया जाएगा, सिवाय जहाँ law ऐसा करना आवश्यक बनाता है।

Liability की सीमा

इस Agreement के अंतर्गत Publisher की total liability incident से पहले के 12 महीनों में Customer द्वारा Service के लिए भुगतान की गई राशि तक सीमित है। Publisher indirect या consequential damages के लिए liable नहीं है।

Termination

कोई भी party written notice देकर Agreement terminate कर सकती है। Termination पर Service इस्तेमाल करने का Customer का license तुरंत समाप्त हो जाता है।

लागू कानून और jurisdiction

यह Agreement और इससे या licensed Service से उत्पन्न अथवा संबंधित dispute, conflict-of-law principles के बिना State of New York, United States के laws और applicable United States federal law द्वारा governed होगा।

Customer के residence में लागू mandatory consumer-protection rights के अधीन, New York County, New York में स्थित state और federal courts को exclusive jurisdiction होगा और Customer उन courts की personal jurisdiction स्वीकार करता है। जहाँ इस Agreement से बदला नहीं जा सकता, mandatory Microsoft Marketplace terms लागू रहेंगे।
